REFORMA TRABALHISTA
Há pontos na proposta da reforma que são aberrações trabalhistas, que discriminam os trabalhadores e excluem, inclusive, regras de direito civil, promovendo diferenças gritantes entre categorias.
Alguns dos pontos de retrocessos desta reforma destacam-se os seguintes:
- Na proposta indica gratuidade de justiça para os patrões e cobrança de acesso à justiça do trabalho aos empregados.
- No ponto que trata do trabalho intermitente, transforma trabalhadores na condição de “avulsos”, com convocações patronais aleatórias e completamente desregulamentadas.
- É uma maldade o ponto da mudança de que trata do negociado sobre o legislado.
- As férias poderão ser parceladas em três vezes ao longo do ano;
- Gestante poderá trabalhar em ambiente insalubre.
- Torna possível exceder a jornada de trabalho legal ou convencionada, sem acordo ou convenção coletiva, e sem a necessidade de comunicação prévia de 10 dias à autoridade competente à matéria trabalhista.
- A jornada fica flexibilizada para permitir que todos os empregadores possam fazê-la apenas por meio de acordo individual. Com isso, o objeto do acordo pode retirar o pagamento em dobro do trabalho realizado em domingos e feriados.
A aprovação do projeto significa o desmonte do direito do trabalho, com precarização do trabalho, terceirização sem responsabilidade, subcontratação e o fim dos grupos econômicos. Ou seja, esse não é um projeto de reforma trabalhista. É um projeto pró-empresário, pois muda totalmente os pilares, os princípios do direito do trabalho, promovendo uma inversão total dos direitos trabalhistas.
REFORMA DA PREVIDÊNCIA
As reformas da Previdência e Trabalhista, além da Lei da Terceirização, já aprovada, desmontam direito sociais conquistados com muita luta pelo povo brasileiro, mas que infelizmente, a maioria dos nossos governantes não escuta e não enxerga a realidade do trabalhador, e sem qualquer diálogo com a sociedade impõe um conjunto de mudanças que afetarão a todos, especialmente os mais pobres.
Dentre os abusos previstos na PEC 287/2016 – Reforma da Previdência, destacam-se os seguintes:
- Exigência de idade mínima para aposentadoria a partir dos 65 (sessenta e cinco) anos para homens e mulheres;
- 49 (quarenta e nove) anos de tempo de contribuição para ter acesso à aposentadoria integral;
- Redução do valor geral das aposentadorias;
- Precarização da aposentadoria do trabalhador rural;
- Pensão por morte e benefícios assistenciais em valor abaixo de um salário mínimo;
- Impede a cumulação de aposentadoria e pensão por morte;
- Elevação da idade para o recebimento do benefício assistencial (LOAS) para 70 anos de idade;
- Regras inalcançáveis para a aposentadoria dos trabalhadores expostos a agentes insalubres;
- Fim da aposentadoria especial dos professores.
Além disso, a reforma da previdência prejudicará diretamente a economia dos municípios, uma vez que a grande maioria sobrevive dos benefícios da previdência social, que superam o repasse do Fundo de Participação dos Municípios (FPM).
