A APLB-Sindicato, entidade que representa os trabalhadores em educação, juntamente com a categoria, defende uma Escola Democrática, entenda-se aqui que essa escola deve agir numa perspectiva democrática, em parceria com a comunidade escolar. Então vejamos quais são os elementos indissociáveis da gestão escolar democrática:
• a eleição do Diretor e Vice-Diretor;
• a Coordenação Pedagógica;
• o Conselho de Escolar;
• a autonomia político-pedagógica, administrativa, gestão dos recursos e patrimonial.
A gestão democrática, que é bandeira de luta dos Trabalhadores e Trabalhadoras em Educação não é um anseio do acaso, mas sim em atenção:
• a Constituição Federal, em seu art. 206, inciso VI, que enumera como um dos princípios segundo os quais o ensino será ministrado em nosso País a “gestão democrática do ensino público”.
• o disposto na Lei Orgânica do Município de Jequié, 1.130/90, define em seu art. 137, parágrafo único, que, “os Diretores e Vice-Diretores dos estabelecimentos municipais de ensino serão escolhidos entre os professores com mais de cinco anos de magistério, na forma da lei, através de eleições diretas”.
• o disposto na Lei nº 9.396/96 (Lei de Diretrizes e Bases da Educação), em seu art. 14, quando define que “Os sistemas de ensino definirão as normas da gestão democrática do ensino público na educação básica, de acordo com as suas peculiaridades e conforme os seguintes princípios: I – participação dos profissionais da educação na elaboração do projeto pedagógico da escola; II – participação das comunidades escolar e local em conselhos escolares ou equivalentes”.
• o disposto na Lei nº 1.445/98, do Estatuto do Magistério Público Municipal de Jequié, em seu art. 24, parágrafo 2º, “Os cargos de Diretor e Vice-Diretor, a critério do chefe do Poder Executivo, poderão ser preenchidos por eleição direta na forma que estabelece a Lei”.
Portanto esses são mecanismos legais devem ser cumpridos pelos gestores municipais e defendidos pelos legisladores municipais. Não cabe aos Vereadores desprezarem esses mecanismos legais que são tão claros com relação ao estabelecimento da gestão democrática no Sistema Educacional do Município, assim como eles foram eleitos, a comunidade escolar também quer ter o direito de escolher o gestor escolar. Direito esse já garantido em forma de lei, conforme explicitado acima.
